1. Acceptance of Terms
By accessing and using ThrottlePal ("the App"), you accept and agree to be bound by these Terms of Use. If you do not agree to these terms, you may not use our services. These terms apply to all users of the App, including trip creators, participants, and visitors.
2. Description of Service
ThrottlePal is a community platform that connects bikers to create, discover, and join group trips. The App allows users to plan routes, coordinate rides, communicate with other bikers, and share their riding experiences. We provide the platform but are not responsible for the actual trips or activities organized through the App.
3. User Accounts
3.1 Account Creation
To use certain features, you must create an account. You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate, current, and complete.
3.2 Account Security
You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must immediately notify us of any unauthorized use of your account.
3.3 Age Requirement
You must be at least 18 years old to use ThrottlePal. By using the App, you represent and warrant that you are at least 18 years of age.
4. Creating and Joining Trips
4.1 Trip Creation
When creating a trip, you agree to provide accurate information about the route, meeting point, time, and any requirements. You are responsible for the safety and legality of the trip you create.
4.2 Trip Participation
When joining a trip, you acknowledge that participation is at your own risk. You are responsible for ensuring you have the necessary skills, equipment, and legal requirements (including valid license and insurance) to participate safely.
4.3 Safety and Responsibility
All participants are responsible for their own safety. ThrottlePal does not provide insurance, safety equipment, or assume any liability for injuries, accidents, or damages that may occur during trips organized through the App.
5. User Conduct
You agree not to:
- Use the App for any illegal purpose or in violation of any laws
- Harass, abuse, or harm other users
- Post false, misleading, or fraudulent information
- Impersonate any person or entity
- Interfere with or disrupt the App or servers
- Create trips that involve illegal activities or dangerous behavior
- Use automated systems to access the App without permission
- Violate any applicable traffic or motor vehicle laws
6. Content and Intellectual Property
6.1 User Content
You retain ownership of content you post, but grant ThrottlePal a worldwide, non-exclusive, royalty-free license to use, reproduce, and display such content in connection with the App.
6.2 App Content
All content, features, and functionality of the App are owned by ThrottlePal and are protected by copyright, trademark, and other intellectual property laws.
7. Disclaimers and Limitation of Liability
7.1 No Warranty
The App is provided "as is" without warranties of any kind. We do not guarantee the accuracy, completeness, or usefulness of any information on the App.
7.2 Limitation of Liability
To the maximum extent permitted by law, ThrottlePal shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from your use of the App or participation in trips.
7.3 Third-Party Interactions
Your interactions with other users, including trip organizers and participants, are solely between you and such users. ThrottlePal is not responsible for any disputes, injuries, or damages that arise from these interactions.
8. Indemnification
You agree to indemnify, defend, and hold harmless ThrottlePal and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising out of or relating to your use of the App, your violation of these Terms, or your participation in trips organized through the App.
9. Termination
We may terminate or suspend your account and access to the App immediately, without prior notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties. You may also terminate your account at any time by contacting us.
10. Changes to Terms
We reserve the right to modify these Terms at any time. We will notify users of material changes by posting the updated Terms in the App and updating the "Last updated" date. Your continued use of the App after such changes constitutes acceptance of the new Terms.
11. Governing Law
These Terms shall be governed by and construed in accordance with applicable laws, without regard to conflict of law principles. Any disputes arising from these Terms or your use of the App shall be resolved in the appropriate courts.
